Court to Reexamine Decision That Allowed Trump to Deploy Troops to Portland
The federal appeals court has maintained a prohibition on deploying national guard in Portland, Oregon, following a latest court ruling.
Appeals Court Concurs to Reconsider Legal Matter
The ninth circuit court of appeals decided on this week that it would rehear the legal dispute concerning the executive power with an expanded panel of 11 judges. The court also overturned a earlier decision from a smaller judicial group that had supported the administration.
Ongoing Dispute Over Military Presence
This legal directive represents the latest turn in a protracted legal battle over whether the administration has the legal right and valid reason to send national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in due to ongoing demonstrations.
Conflicting Arguments
The federal government has claimed that government employees at the ICE facility in south Portland were under attack, while local authorities maintain that municipal police have control of the circumstances.
Contrary to characterizations of Portland as a conflict zone, locals have been posting footage of scenic paths and a thriving food scene, and organizing events such as an protest bicycle event against the increased military presence.
Court Proceedings
The Tuesday ruling came after a US district judge in Portland enacted two legal injunctions this period – one preventing the federalization of the Oregon national guard, and another prohibiting the use of any national guard troops in Oregon, after attempts to evade the initial injunction by mobilizing troops from California.
On the previous day, the ninth circuit panel had temporarily suspended the initial decision – permitting control of state troops – but the second ruling stayed effective, preventing the physical sending of the forces.

The latest ruling means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a group of 11 judges.
“This ruling demonstrates that the truth matters and that the judicial system are working to hold this administration accountable. The founding document limits the executive authority, and local populations cannot be treated as a training ground for expansive government power,” stated the legal representative in a official comment.
“The judicial body is sending a clear message: the president cannot send the armed forces into US cities unnecessarily. We will continue protecting Oregon’s laws, values, and sovereignty as this case moves forward and our legal battle continues in the courts.”
